These Terms of Use (“Terms”) govern your access to and use of the Here to Serve website, digital platforms, and related services (collectively, the “Services”). Please read these Terms carefully before using the Services.

1. Acceptance of Terms

By accessing, browsing, or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not access or use the Services.

If you are using the Services on behalf of an organization, you represent and warrant that you are authorized to bind that organization to these Terms.

2. Mission and Purpose

Here to Serve (“HTS,” “we,” “our,” or “us”) is a nonprofit organization dedicated to serving communities through charitable, educational, and humanitarian initiatives. The Services are intended solely to advance this mission. Use of the Services in a manner inconsistent with our mission is prohibited.

3. Eligibility

You must be at least eighteen (18) years old to use the Services. By using the Services, you represent and warrant that you meet this requirement and that you are legally competent to enter into these Terms.

4. Modification of Terms

We may revise these Terms at any time by posting an updated version on our website. Changes are effective immediately upon posting. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

5. No Professional or Legal Advice

Information provided through the Services is for general informational and educational purposes only. It does not constitute legal, medical, financial, or other professional advice. You should consult a qualified professional before relying on any information provided through the Services.

6. Ownership and Intellectual Property

All content, materials, text, graphics, logos, images, videos, and software made available through the Services (“Content”) are owned by or licensed to Here to Serve and are protected by applicable intellectual property laws.

You agree not to use the Services to:

9. Donations, Event Fundraising, and Payments

Here to Serve may offer the ability to make donations or participate in event-related fundraising pages through the Services. By making a donation or contribution, you represent and warrant that you are at least eighteen (18) years of age and authorized to use the payment method provided.

All donations and fundraising contributions are voluntary and, to the fullest extent permitted by law, non-refundable, including donations made in connection with events, campaigns, or fundraising pages. Here to Serve does not guarantee that any fundraising goal will be met or that funds raised for a particular event or initiative will be used in any specific manner, except as reasonably aligned with our charitable mission.

Payment processing may be conducted by third-party service providers. Here to Serve does not store full payment card information and is not responsible for the acts or omissions of third-party payment processors, which are governed by their own terms and privacy policies.

10. Third-Party Links

The Services may contain links to third-party websites or services. We do not control and are not responsible for the content, policies, or practices of third parties. Accessing third-party resources is at your own risk.

11. Disclaimer of Warranties

The Services and all Content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, Here to Serve shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services, even if advised of the possibility of such damages.

Your sole remedy for dissatisfaction with the Services is to stop using them.

13. Indemnification

You agree to indemnify and hold harmless Here to Serve, its officers, directors, employees, volunteers, and agents from any claims, liabilities, damages, or expenses arising from your use of the Services or violation of these Terms.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is inconsistent with our mission.

15. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located within the State of California, and you consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and Here to Serve regarding use of the Services and supersede all prior agreements or understandings.
